These Terms and Conditions (“Terms”) govern your use of the Allen Sportswear Inc. website at allensportswear.com (the “Site”), the My Account portal, and any purchase of custom athletic uniforms from Allen Sportswear Inc. (“Allen Sportswear,” “we,” “us,” or “our”). By using the Site or submitting a quote request, you agree to these Terms.
If you are acting on behalf of an organization (school, league, club, or team), you represent that you have authority to bind that organization.
1. Scope of These Terms
These Terms apply to your use of the Site (including the uniform design builder, the My Account portal, and any account features), your submission of quote requests, and any agreement to purchase products from Allen Sportswear.
2. Use of the Site
You may use the Site for lawful purposes related to evaluating or purchasing Allen Sportswear products for your team or organization. You agree not to:
- Use the Site in any way that violates applicable law
- Attempt to interfere with the Site’s operation or security
- Submit false, misleading, or spam information through our forms
- Copy or reproduce Site content without written permission
- Use automated tools to submit quotes or extract product information at scale
We reserve the right to refuse service to anyone for any reason.
3. Quotes, Orders, and the Ordering Process
3a. What makes an order official
A quote is the start of a conversation, not a binding order. An order becomes official once two things are in place: you have approved and signed your order form (or, once the website supports it, placed your order online), and we have an approved form of payment, meaning a deposit or payment in full, a verified purchase order, or a cleared check.
3b. Minimum order quantity
Our minimum order quantity is 8 pieces per order.
3c. Custom nature of orders
All Allen Sportswear products are custom-manufactured to your specifications. We do not carry stock inventory of finished uniforms.
3d. Production sample approval
For most orders, we produce a physical production sample before the full run. You will be asked to review and approve the sample before full production begins. Your approval confirms that the design, colors, and construction meet your expectations. We are not responsible for differences you approved at the sample stage.
If you reject the sample, we will work with you to address the issue.
3e. Typical turnaround
Our typical production turnaround is 3 to 4 weeks from order confirmation (not from quote request). Timelines may vary based on order complexity, quantity, and production schedule. Rush production may be available; contact your sales representative for details.
We are not responsible for delays caused by factors outside our control, including shipping carrier delays, natural events, or late delivery of materials we source from third parties.
4. Pricing and Payment
Most orders are paid in full when you place them. For schools, established programs, and approved accounts, we also offer a split: 50% to start production and the other 50% before your order ships. Your rep will confirm whether the split fits your order and the accepted payment methods. All prices are in US dollars and follow your confirmed quote. We collect Florida sales tax on orders shipped in Florida; tax-exempt organizations just send us their certificate.
5. Cancellations and Changes
Because every order is made just for your team, timing is everything. Before you approve your sample: this is the time to make it perfect. Need to adjust a name, number, color, or size? Just tell your rep. We would always rather fix it now than after. Once your order goes into production: at that point your fabric is cut and your team has its spot in our production schedule, so we can no longer change or cancel the order. It is the one trade-off of truly custom gear, and it is why we take the sample-approval step seriously. Because your deposit goes toward design work and the materials we commit early, it is non-refundable once your order is confirmed. Approving your sample: when you approve your production sample, you are confirming the spelling, names, numbers, colors, and layout are exactly right. We build to that approval, so give it a careful look. One honest note on color: screens and mockups can show a shade a little differently than the finished fabric, so your approved sample is the true reference, not the screen.
6. Shipping and Delivery
Your order ships to you fully tracked and insured. We send tracking the moment it is on its way, and if anything arrives late, lost, or damaged, contact us right away and we work directly with the carrier to resolve it and get your team taken care of. Shipping details are set with your confirmed quote. We ship throughout the US, and we can ship internationally as well, just give us a call so we can set it up.
7. Product Quality and Defects
If anything arrives with a manufacturing defect, something that is on us, we make it right. Send us a photo within 3 days of delivery and we will replace or repair the affected pieces. This covers real defects, not normal wear or washing, sizes you approved at the sample stage, or design choices you signed off on.
8. Customer-Provided Artwork and Logos
When you provide logos, wordmarks, or other artwork for your uniform design, you represent that you own the rights to that artwork or have permission to use it, and that it does not infringe any third-party rights.
By providing artwork, you grant Allen Sportswear a limited license to use it solely for producing your order. We will not use your artwork for any other purpose.
You agree to defend and hold harmless Allen Sportswear from any claim arising from your artwork.
9. Intellectual Property
The Site and its content, including the Allen Sportswear name, logo, uniform designs, photography, text, and software, are owned by or licensed to Allen Sportswear Inc. and are protected by copyright, trademark, and other applicable laws. You may not copy or reproduce our content without written permission.
Uniform designs based on our templates remain our intellectual property until your order is confirmed and paid. Upon completion of a paid order, the custom design applied to your specific order is yours for use with your team.
10. User Accounts and Saved Designs
If the Site allows you to create an account and save designs, you are responsible for keeping your login credentials secure. We may close accounts that are inactive for an extended period or that violate these Terms, and we will attempt to provide notice before deleting saved design data.
11. Disclaimer of Warranties
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE EXTENT PERMITTED BY APPLICABLE LAW. OUR PRODUCT QUALITY COMMITMENTS ARE DESCRIBED IN SECTION 7. NOTHING IN THIS SECTION LIMITS THOSE SPECIFIC COMMITMENTS.
12. Limitation of Liability
TO THE EXTENT PERMITTED BY APPLICABLE LAW, ALLEN SPORTSWEAR’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS, THE SITE, OR ANY PRODUCT SHALL NOT EXCEED THE AMOUNT YOU PAID IN CONNECTION WITH THE SPECIFIC ORDER GIVING RISE TO THE CLAIM. IN NO EVENT SHALL ALLEN SPORTSWEAR BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
13. Indemnification
You agree to defend, indemnify, and hold harmless Allen Sportswear Inc. and its officers, employees, and agents from claims arising from your use of the Site in violation of these Terms, your violation of applicable law, or your breach of Section 8.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida. Any dispute shall be resolved in the state or federal courts located in Orange County, Florida. You consent to the personal jurisdiction of those courts.
15. Changes to These Terms
We may update these Terms from time to time. The “Last Updated” date at the top reflects the most recent revision. Continued use of the Site after changes are posted means you accept the revised Terms.
